Works Copyright Decision

Adopted on 28 May 2012

The President of the Union has adopted this decision:

Article 1
General

1. This decision shall be titled the Works Copyright Decision.

2. This decision, in accordance with Article 13 of the Constitution, establishes a framework for the Union to publish various types of copyrightable works.

Article 2
Definitions

3. In this decision:

1. "a work" refers to a copyrightable work produced under the auspices of the Union or published by the Union;
2. "the author" means the author of a copyrightable work produced under the auspices of the Union or published by the Union.

Article 3
Copyright

4. The copyright for a work shall remain with the author.

5. The author shall agree to grant to the Union a non-exclusive, worldwide, royalty-free license to use, publish and display the work for non-commercial purposes on condition of the Union ensuring that appropriate and proper attribution in relation to the author of a work is given.

6. All rights granted to the Union under the terms of paragraph 5 by the author shall be granted for the term of copyright on the work, and be irrevocable provided the stated conditions are met.

Article 4
License

7. Before the works of an author may be published by the Union, the author shall submit the following to the President of the Union through an email message:

I, <the author's full name> (<the author's username>), hereby agree to grant to the United European Pokémon Communities a non-exclusive, worldwide, royalty-free license to use, publish and display, for non-commercial purposes, any copyrightable works produced by me under the auspices of the Union or published by the Union provided that appropriate and proper attribution is given. All rights granted to the United European Pokémon Communities under these terms are granted for the term of copyright on the work, and are irrevocable provided the stated conditions are met.

8. In the case that author intends to publish a work under a Creative Commons or similar license, the provisions of paragraphs 4, 5 and 6 of this decisions shall not apply.

9. When using, publishing and displaying works published under a Creative Commons or similar license, the Union shall ensure to uphold the full compliance with the relevant license.
